RETURN & CANCELLATION

The return policy and the right of withdrawal are part of our general terms and conditions and are described separately here on the website for easier findability.

§1 Right of withdrawal for consumers
The right of withdrawal only applies to consumers in distance selling.

§2 Cancellation policy for consumer contracts
Right of withdrawal: as of 2024/10/15
Consumers have the right to withdraw from this contract within 14 days without giving any reason.
The cancellation period is 14 days from the day:

• on which the consumer or a third party other than the carrier designated by the consumer takes possession of the goods, provided that the consumer has ordered one or more goods as part of a single order and these are or will be delivered as a single product;
• on which the consumer or a third party other than the carrier designated by him takes possession of the last good, provided that several goods were ordered as part of a single order and these are delivered separately;
• on which the consumer or a third party other than the carrier designated by him takes possession of the last partial delivery or the last piece, provided that goods have been ordered which are to be delivered in several partial deliveries or pieces.

To exercise the right of withdrawal, the affected consumer must inform us, GADGETTO GmbH (see Legal Notice ), of his decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, by telephone or by email). Consumers can use the attached model withdrawal form for this purpose, although this is not mandatory. To meet the withdrawal deadline, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the withdrawal period has expired.

§3 Non-existence of a right of withdrawal

Unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts:

• Contracts for the supply of goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
• Contracts for the supply of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery,
• Contracts for the delivery of goods if, after delivery, they have been inseparably mixed with other goods due to their nature,
• Contracts for the supply of sound or video recordings or computer software in a sealed package, if the seal has been removed after delivery.

It is also pointed out that persons who are not consumers within the meaning of Section 13 of the German Civil Code (BGB) have no right of withdrawal with regard to the goods purchased.

§4 Consequences of revocation
If a contract is cancelled, we will refund all payments made by the consumer, excluding delivery costs (for a justified guarantee or warranty case and with the exception of the additional costs resulting from the fact that the consumer has chosen a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within thirty days from the day on which we received notification of the cancellation of this contract. For this refund, we will use a means of payment chosen by us or the same means of payment that the consumer used for the original transaction, unless something else was expressly agreed upon at the consumer's request - under no circumstances will the consumer be charged any fees for this refund. We may refuse to refund until we have received the goods back or until the consumer has provided proof that he has returned the goods, whichever is earlier.
Consumers must return or hand over the goods to us promptly and in any event no later than 14 days from the date on which the consumer notifies us of the cancellation of this contract. This deadline is met if the goods are dispatched before the expiry of the 14-day period. Consumers do not bear any costs for returning the goods. Consumers only have to pay for any loss of value of the goods if this loss of value is due to handling by the consumer which is not necessary to check the quality, properties and functioning of the goods.

§5 Sample cancellation form

§6 General information

§6.1 Please avoid damaging or contaminating the goods, this also includes damaging or contaminating the original packaging (not outer packaging) or accessories.

§6.2 Please send the goods back to us in an outer packaging with the original packaging included, with all accessories and all packaging components. If necessary, use new protective outer packaging if the packaging sent to you can no longer be used. If you no longer have the original packaging, please ensure that you use suitable packaging to ensure adequate protection against transport damage.

§6.3 Please do not send the goods back to us freight collect.

§6.4 Please note that the integrity of the packaging is not a prerequisite for the effective exercise of the right of withdrawal.
