HAMBERGER Medical products are subject to strict quality controls.
Every product of the HAMBERGER Medical brand that you purchase through this shop has a statutory warranty and a guarantee of 2 years from the date of purchase via shop.hamberger-medical.com.
 
Warranty conditions:
This guarantee is valid for consumers within the meaning of our General Terms and Conditions for a period of 2 years from the date of purchase in our shop at shop.hamberger-medical.com.
HAMBERGER Medical guarantees that the HAMBERGER Medical brand products covered by the guarantee are free from material, manufacturing and design defects. The state of science and technology at the time of manufacture is decisive here.
A warranty claim arises if the product already had the defect that caused the damage at the time of purchase through our shop. Claims for compensation for consequential damage or product liability only exist in accordance with the mandatory statutory provisions.

The guarantee includes in particular the proper functionality in accordance with the functions contained in the description, freedom from defects in materials and their surfaces, in particular plastics, metallic surfaces and lowering damper units.
For HAMBERGER Medical brand toilet seats where the automatic lowering mechanism is part of the toilet seat, the following applies with regard to the guaranteed correct lowering function : According to the current state of science and technology, the damping function weakens over the course of its service life (degradation), but it does not suddenly fail. Aging is a normal process. This means that the reduction in the damping effect of automatic lowering mechanisms (SoftClose) does not represent a defect.
 
To claim the guarantee, the following steps are necessary:
You can assert the rights under this guarantee by notifying us of the defect in writing . The prerequisite for this is that you notify us immediately after becoming aware of the defect within the guarantee period. You must also present the order confirmation or proof of purchase for the HAMBERGER Medical brand products covered by the guarantee and evidence (photo/video) of the defect in question. We reserve the right to request the product to be presented in order to assess the guarantee case and to regard this as a prerequisite for determining a guarantee case.

Please note that products that are returned to us without notice or comment CANNOT be processed. In the event of a warranty claim, always contact us first as the shop operator using the contact details of GADGETTO Products GmbH:

Warranty exclusion:
This warranty further includes the conditions that:

• the products were used as intended,
• no additions, conversions or other modifications were made without authorization,
• the maintenance and care of the products has been carried out in accordance with the instructions in the operating and installation instructions,
• Assembly and installation have been carried out in accordance with the installation instructions,
• there are no chemical or physical effects on the material surface or on the product in general that have arisen from improper use, for example damage caused by incorrect cleaning or cleaning agents or sharp-edged objects.

Damage caused by the above conditions is not covered by the guarantee if:

• these products were not purchased as second-choice items or samples,
• these products were not purchased at the factory outlet (proof of receipt).

Warranty services:
We are free to repair the product (or provide you with the necessary replacement materials to replace defective components by your own implementation), to make an exchange or to refund the purchase price to you.
In the event of an exchange, the old product will be replaced free of charge with a new product of the same kind, quality and type. If the product in question is no longer manufactured at the time the fault is reported, we are entitled to supply a similar product.
Costs, expenses, postage and the like incurred by the guarantee holder will not be reimbursed.
Assembly, disassembly and transport costs will not be reimbursed. Loss of profit, loss of earnings and consequential damages resulting from a defect in our products are not covered by the guarantee.

Notes on guarantee promise, § 477 BGB:
Regardless of the voluntary dealer guarantee and whether or not the prescribed guarantee is claimed in the event of a guarantee claim, the statutory warranty rights against the seller remain unconditional. At your own discretion, you can therefore assert the statutory buyer rights against the seller due to defects in the purchased item - in particular subsequent performance, withdrawal, reduction of the purchase price or compensation (see Section 437 of the German Civil Code and the corresponding special limitation provisions in Section 438 of the German Civil Code) - in addition to or without asserting the guarantee claims. The guarantee applies without prejudice to mandatory statutory liability provisions, such as those under the Product Liability Act, in cases of intent and gross negligence, due to injury to life, body or health by HAMBERGER Medical GmbH or its vicarious agents.
